Terms of Service

• You must be at least 13 years old to use the Service, and at least 18 to purchase a subscription.
• You agree to provide accurate account information and to keep your credentials secure. You are responsible for all activity under your account.
• One person or entity per account. Do not share, sell, or transfer your account.

Flux Fishing Forecast aggregates public oceanographic and meteorological data and uses automated analysis (including AI) to produce fishing forecasts, maps, spot reports, and related tools. Forecasts are informational predictions, not guarantees. The conditions at sea change rapidly, and the data we rely on may be delayed, incomplete, or in error.

The Service is NOT a navigation, weather-safety, or life-safety system and must never be used as one. Do not rely on it for any decision affecting safety of life or property at sea. Always consult official sources — the National Weather Service, NOAA, the U.S. Coast Guard, and certified marine charts and instruments — and use your own judgment before heading out. You are solely responsible for your safety and the safety of your crew and vessel.

• Paid plans are billed in advance on a recurring basis (monthly or annually) through Stripe (web) or the Apple App Store (iOS), and renew automatically until cancelled.
• You can cancel anytime; cancellation stops the next renewal and access continues through the end of the current paid period. We do not provide prorated refunds for partial periods except where required by law.
• iOS purchases are governed by Apple's terms and managed through your Apple account; App Store refunds are handled by Apple.
• Weekend Passes, promotional credits, and free or promotional access have no cash value and are non-transferable.
• We may change prices on a going-forward basis with notice; a change never affects a period you have already paid for.

• You retain ownership of content you submit — catch logs, photos, waypoints, comments, and profile information.
• You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content as needed to operate the Service, including displaying content you choose to make public or share with other users per your sharing settings.
• You are responsible for your content and confirm you have the rights to submit it. Do not upload anything unlawful, infringing, or that you lack permission to share.
• Community content (comments, posts) passes through automated moderation and may be removed at our discretion.

You agree not to:

• Scrape, crawl, resell, or redistribute the Service's data or forecasts without our written permission.
• Reverse engineer, interfere with, or attempt to gain unauthorized access to the Service or its systems.
• Harass, threaten, or abuse other users, or post unlawful, fraudulent, or harmful content.
• Use the Service to violate any fishing regulation or applicable law. You are responsible for knowing and following all licensing, size, bag, season, and protected-area rules in your jurisdiction.

The Service — including its software, design, maps, generated reports, and branding — is owned by FLUX LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use (or internal business use for charter / Captain plans). All rights not expressly granted are reserved.

The Service incorporates data from public providers (including NOAA, NASA, NDBC, NWS, and OPC) and relies on third-party services (including Stripe, Anthropic, Apple, and Amazon Web Services). We do not control and are not responsible for third-party data accuracy or availability, and your use of those services may be subject to their own terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that forecasts will be accurate, that the Service will be uninterrupted or error-free, or that it will meet your expectations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUX LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROPERTY, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You agree to indemnify and hold harmless FLUX LLC from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or where required by law. Provisions that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification) will survive.

We may update these Terms as the product evolves. The "Last updated" date reflects the latest revision, and material changes will be announced to active accounts. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
